Thanks to an Obama administration era policy, I-601A Waivers are still an extraordinary option allowing many immigrants presently in the US without legal status to obtain their green card. The process requires a qualifying US citizen or lawful permanent resident relative to petition on their behalf. The applicant would then file a provisional waiver based on extreme hardship to the US citizen or LPR petitioner/qualifying relative. Upon approval, applicants can travel back to their home country for a visa interview. To date, we have a 99% success rate with most applicants remaining outside the US for no more than 14 days.
